PRIVACY POLICY
For www.luxeriaglobal.com
Last Updated: 4 September 2026
This Privacy Policy explains how Luxeria Global ("Luxeria Global", "Luxeria", "we", "us" or "our") collects, uses, stores, processes, shares and protects personal data when you visit, browse, communicate with us, create an account, place an order, submit an enquiry, use any feature of, or otherwise interact with www.luxeriaglobal.com and related services (collectively, the "Services"). This consolidated policy has been prepared from Luxeria Global's existing website/privacy materials and updated for an India-based Shopify ecommerce business serving customers in India and potentially other jurisdictions. It should be read together with our Terms and Conditions and any other notices displayed at the point where personal data is collected.
1. Who We Are and Scope
Luxeria Global operates www.luxeriaglobal.com and offers premium home décor, gifting and related products and services, including retail, customised, made-to-order, B2B and international requirements where offered. For personal data for which Luxeria Global determines the purposes and means of processing, Luxeria Global acts as the relevant data fiduciary/data controller or equivalent role under applicable law. Our ecommerce store is powered by Shopify. Shopify may act as a processor/service provider on our behalf for certain services and, for certain Shopify consumer or enhanced services, may process data in its own controller/business capacity. This Policy applies to visitors, prospective customers, customers, account holders, persons making enquiries, B2B contacts and other individuals whose personal data is processed through the Services. It does not govern third-party websites or services that have their own privacy notices.
2. Applicable Privacy Framework
We intend to handle personal data in accordance with privacy and data-protection laws applicable to our processing. For India, this includes the Digital Personal Data Protection Act, 2023 ("DPDP Act") and the Digital Personal Data Protection Rules, 2025, to the extent the relevant provisions are in force and applicable, together with other applicable Indian legal requirements. Where our activities are subject to privacy laws outside India, additional rights or requirements may apply, including, where applicable, the EU General Data Protection Regulation (GDPR), UK GDPR or applicable U.S. state privacy laws. References to such rights in this Policy apply only where the relevant law applies to the individual and the processing concerned.
3. Personal Data We Collect or Process
Personal data means information that identifies you or can reasonably be linked to you. It does not include information that has been irreversibly anonymised or de-identified so that it can no longer reasonably identify you. Depending on how you interact with the Services, we may collect or process the following categories: Identity and contact data: name, billing address, shipping address, postal address, email address, telephone/mobile number and similar contact details. Account data: username or account identifier, password or authentication information, preferences, settings and account-related information. Order and transaction data: products viewed, selected, placed in a cart or wishlist, purchased, returned, exchanged or cancelled; order history; transaction status; delivery details; invoices and related records. Payment-related data: payment method, payment status, transaction reference, payment confirmation and other payment details. Full card or banking credentials may be collected and processed directly by the applicable payment gateway or payment service provider rather than stored by Luxeria Global. Communications: information contained in emails, forms, customer-support requests, telephone or messaging interactions, feedback, enquiries and other communications with us. Device and technical data: IP address, browser type, device type, operating system, network information, device identifiers and similar technical information. Usage and browsing data: pages or products viewed, interactions with the Services, referral information, session information, navigation activity, cart activity and similar usage information. Marketing and preference data: communication preferences, interests, consent or opt-out choices and information used to understand or personalise marketing, where permitted. User-generated data: product reviews, comments, photographs or other material you voluntarily submit where such functionality is available. B2B/customisation data: business name, designation, business contact details, tax/shipping information, specifications, sampling/customisation requirements and related correspondence where you engage us for B2B, sourcing, customised or export requirements. We ask that you do not send sensitive or confidential personal data that is not necessary for the relevant transaction or enquiry.
4. Sources of Personal Data
We may obtain personal data: directly from you when you browse, register, order, enquire, contact us, submit a form, provide a review or otherwise interact with us; automatically through cookies, pixels, tags, local storage, server logs and similar technologies when you use the Services; from Shopify and applications or integrations used to operate the store; from payment processors, logistics/shipping providers, customer-support providers and other service providers; from marketing, advertising, analytics, social-media or business partners, where permitted by law; and from other lawful third-party or publicly available sources where relevant to a B2B relationship, fraud prevention, compliance or another legitimate business purpose.
5. How We Use Personal Data
Depending on the circumstances and applicable law, we may process personal data for the following purposes:
5.1 Providing and Improving the Services
to operate, administer, maintain and improve our website and Services; to create and manage customer accounts and remember preferences; to display products and provide a tailored shopping experience; to process orders, purchases, returns, exchanges, cancellations and refunds; to arrange packing, fulfilment, shipping and delivery; to respond to enquiries and provide customer service; to enable product reviews or other user features where available; to manage customised, made-to-order, B2B, sampling, sourcing or export-related requests; and to understand how customers use our Services and improve products, content and functionality.
5.2 Payments
We use payment-related information to facilitate and confirm transactions, detect payment errors and fraud, process refunds and maintain legally required financial and transaction records. Payment processing may be performed by third-party payment gateways and financial institutions under their own terms and privacy notices.
5.3 Marketing, Advertising and Personalisation
Subject to applicable law and your choices, we may use personal data to send promotional communications by email, SMS, messaging service or other permitted channels, recommend products, measure campaigns and display or facilitate advertising based on your interactions with our Services. Where consent is required for cookies, targeted advertising or marketing, we will seek it through the appropriate mechanism.
5.4 Security and Fraud Prevention
We may use personal data to authenticate accounts, secure transactions, detect and investigate suspected fraud, unlawful activity, abuse, security incidents or malicious activity, protect our customers and business, and maintain the integrity of the Services.
5.5 Legal, Regulatory and Business Purposes
We may process information to comply with applicable law, tax/accounting requirements, lawful government or law-enforcement requests, court orders or legal process; establish, exercise or defend legal claims; enforce our Terms and policies; resolve disputes; conduct audits; and protect our rights, property, users and others.
6. Legal Basis and Consent
We process personal data only where we have an appropriate basis under applicable law. Depending on the jurisdiction and circumstances, this may include your consent, processing necessary to perform a contract or take steps at your request, compliance with a legal obligation, a permitted legitimate use or legitimate interest, or another basis recognised by applicable law. Where processing is based on consent, you may withdraw that consent through the method provided or by contacting us. Withdrawal will not affect the lawfulness of processing already undertaken before withdrawal, and we may continue processing where another lawful basis permits or requires it.
7. Cookies and Similar Technologies
Our website and the technologies supporting it may use cookies, pixels, tags, local storage and similar technologies to keep the site functioning, remember preferences, understand website usage, support security, measure performance, enable shopping functionality and, where configured, support analytics, personalisation and advertising. Some cookies are necessary for the website to function. Other cookies may be optional and, where required by applicable law, will be used only after the relevant consent or choice. You may be able to manage cookies through our cookie/privacy controls and your browser settings. Blocking certain cookies may affect website functionality. The exact cookie categories and third-party analytics/advertising technologies used by Luxeria Global should correspond to the store's live Shopify configuration and any installed apps.
8. How We Disclose Personal Data
We do not disclose personal data indiscriminately. We may disclose or make it available where reasonably necessary for the purposes described in this Policy, including: to Shopify and its relevant subprocessors/service providers that support our ecommerce platform; to payment gateways, payment processors, banks and fraud-prevention providers to process and secure payments; to logistics, courier, shipping, warehousing, fulfilment and delivery providers; to IT, hosting, cloud, security, customer-support, communications, professional and operational service providers; to analytics, marketing, advertising or business partners where those services are used and the disclosure is lawful; to affiliates or entities within a corporate group, if applicable; to a buyer, investor, adviser or other relevant party in connection with an actual or proposed merger, acquisition, restructuring, financing, sale of assets, insolvency or similar corporate transaction, subject to appropriate safeguards; to courts, regulators, government bodies, law-enforcement agencies or other parties where required or permitted by law, legal process or to protect rights and safety; and to other third parties where you direct us, request the disclosure or provide appropriate consent. Third parties that independently determine how they use personal data may process it under their own privacy notices. We encourage you to review those notices.
9. Our Relationship with Shopify
The Services are hosted and supported by Shopify. Information submitted to or generated through the store may be transmitted to and processed by Shopify and its service providers in order to provide, secure, develop and improve Shopify services. Under Shopify's current Data Processing Addendum, a merchant generally acts as data controller and Shopify as data processor/service provider for customer personal data processed to provide relevant merchant services. For certain enhanced services, Shopify may process customer personal data as a separate controller/business. Shopify also acts directly in relation to certain consumer services such as Shop or Shop Pay. Shopify's processing may involve infrastructure and service providers located in countries other than your country of residence. Shopify's own Consumer Privacy Policy and applicable terms govern processing for which Shopify acts independently. If Luxeria Global enables Shopify enhanced services or Shopify Network Intelligence, additional disclosures, consent/opt-out mechanisms or cookie controls may be required depending on the customer's jurisdiction. Luxeria Global should keep its published policy and Shopify Customer Privacy settings aligned with the features actually enabled.
10. Third-Party Websites, Social Media and Integrations
The Services may contain links, social-media widgets, login integrations or other connections to third-party websites or platforms. We do not control and are not responsible for the privacy, security, content, accuracy or practices of unaffiliated third parties. Your use of a third-party service is subject to that party's terms and privacy notice. Information you post in a public or semi-public area, including product reviews or third-party social platforms, may be visible to others. Please avoid posting information you do not wish to make public.
11. Public Reviews and User Submissions
Where the website permits reviews, comments or other public submissions, the information you choose to post may become publicly accessible. We may moderate or remove content in accordance with our Terms and applicable law. Privacy-related handling of the account or contact information associated with a submission remains subject to this Policy.
12. Children's Privacy
The Services are intended for persons capable of entering into the relevant transaction under applicable law and are not directed at children for the purpose of knowingly collecting their personal data. Where applicable law requires verifiable consent from a parent or lawful guardian before processing a child's personal data, we will seek such consent or refrain from the processing. If you believe a child has provided personal data to us contrary to applicable law, please contact us so that we can review and, where appropriate, delete or otherwise address the information.
13. Data Security
We use reasonable administrative, technical and organisational measures designed to protect personal data against unauthorised access, use, alteration, disclosure, loss or destruction. Service providers such as Shopify also maintain security measures for the data they process in connection with their services. No method of transmission over the internet or electronic storage is completely secure. We therefore cannot guarantee absolute security. Please do not send sensitive or confidential information through unsecured channels, and keep your account credentials confidential.
14. Data Retention
We retain personal data only for as long as reasonably necessary for the purposes for which it was collected and for legitimate business or legal requirements. Retention may depend on factors including the duration of your account or customer relationship, order fulfilment, warranty/return requirements, tax and accounting obligations, dispute resolution, fraud prevention, legal claims and enforcement of agreements. When personal data is no longer required, we may delete, anonymise or securely dispose of it, subject to applicable legal, backup and technical requirements. Specific retention periods should reflect Luxeria Global's actual operational and statutory record-keeping practices.
15. Your Rights and Choices
Depending on where you live and the law applicable to the processing, you may have some or all of the following rights. These rights are not absolute and may be subject to legal conditions, exceptions and identity verification: Access / Know: request information about or access to personal data we hold about you. Correction / Updating: request correction of inaccurate or incomplete personal data. Deletion / Erasure: request deletion of personal data where the applicable conditions are met. Data Portability: where provided by applicable law, receive certain personal data in a portable form or request its transfer. Consent Withdrawal: withdraw consent for processing based on consent. Marketing Opt-Out: unsubscribe from promotional emails using the unsubscribe mechanism or contact us to update marketing preferences. We may continue to send transactional or service messages concerning orders, accounts or legal matters. Objection / Restriction: where applicable, object to or request restriction of certain processing. Targeted Advertising / Sale or Sharing Choices: where applicable law grants such rights and the relevant processing occurs, exercise available opt-out choices. Grievance / Complaint: raise a grievance with us and, where applicable, approach the competent data-protection authority or statutory body. Nomination: where applicable under Indian data-protection law, nominate another individual to exercise rights in the event of death or incapacity, subject to applicable requirements. We may request information reasonably necessary to verify your identity and the validity of a request. Where permitted by law, an authorised representative may make a request on your behalf, subject to proof of authority and appropriate verification. We will not unlawfully discriminate against you for exercising an applicable privacy right.
16. Privacy Requests and Grievance Redressal
To exercise an applicable privacy right, withdraw consent, ask a privacy question or raise a grievance, please contact Luxeria Global using the details in Section 22. We will review and respond to requests and grievances within the time and manner required by applicable law.
17. International and Cross-Border Transfers
Luxeria Global serves or may serve customers outside India and uses service providers with international operations. Accordingly, personal data may be transferred to, stored in or processed in countries other than the country in which you reside. We will handle cross-border transfers in accordance with applicable law. Where European, UK or other laws require a recognised transfer safeguard, relevant parties may rely on an adequacy decision, standard contractual clauses, an international data transfer agreement/addendum or another lawful mechanism, as appropriate. For transfers governed by Indian law, we will comply with restrictions or conditions on cross-border processing or transfer that are applicable from time to time.
18. International Visitors and Jurisdiction-Specific Rights
If you are located in the European Economic Area, United Kingdom, Switzerland or another jurisdiction with specific privacy rights, additional rights may apply where the relevant law governs our processing. These may include rights of access, rectification, erasure, restriction, objection, portability, withdrawal of consent and complaint to a supervisory authority. If an applicable U.S. state privacy law governs our processing, you may have rights concerning access, correction, deletion, portability and, in some circumstances, opt-out of sale, sharing or targeted advertising. We do not represent that every foreign privacy statute applies to every visitor; rights depend on the relevant law, thresholds and processing circumstances.
19. Business Transfers and Corporate Changes
If Luxeria Global undergoes or considers a merger, acquisition, financing, restructuring, sale or transfer of all or part of its business or assets, insolvency or similar transaction, personal data may be disclosed to relevant advisers, counterparties or successors as permitted by law and subject to appropriate confidentiality and privacy protections.
20. Legal Disclosures
We may preserve, use or disclose personal data where we reasonably believe this is necessary to comply with applicable law or valid legal process; respond to lawful requests from courts, regulators, law-enforcement or government agencies; investigate actual or suspected violations of law or our Terms; prevent fraud or security threats; or protect the rights, property, safety and security of Luxeria Global, our customers or others.
21. Changes to This Privacy Policy
We may update this Privacy Policy from time to time to reflect changes in our Services, technologies, vendors, business practices or legal and regulatory requirements. The revised version will be posted on www.luxeriaglobal.com with an updated "Last Updated" date. Where required by law, we will provide additional notice or obtain consent for material changes.
